Terms and conditions
These terms apply to every purchase of access to a course on highperformer-certs.com and to the use of the learning app.
1. Who we are and scope
The provider is Marc Cherier, trading as High Performer Certs, Massower Str. 13, 10315 Berlin, Germany, email marc.cherier@outlook.de (“we”, “us”). These terms apply to contracts with consumers and with businesses. The contract language is English.
2. What we provide
We provide online access to study courses for professional exams, starting with SQE1 (Solicitors Qualifying Examination Part 1, England and Wales). A course includes the question bank with explanations and sources, spaced repetition, mock exams, an error log and progress tracking, as described on the course page at the time of purchase.
The courses are study material. They are not legal advice, we do not guarantee that you will pass any exam, and we are not affiliated with the Solicitors Regulation Authority or any other exam body. Exam rules, dates and fees are set by the exam body; please check them there.
3. Account
You need a personal account to use a course. Please give accurate details and keep your sign-in details confidential. An account is for one person only and may not be shared.
4. How the contract is made
The course pages are not a binding offer. To buy, you sign in, tick the consent box described in section 7 and start the checkout. You place a binding order by clicking the button in the checkout that is marked as an order with an obligation to pay. Before that, you can check and correct your details. The contract is concluded when the payment is confirmed and we give you access. We send you a confirmation with the contract details, including your consent under section 7, by email; the receipt and invoice are sent separately by Link (see below).
Payment through Stripe Managed Payments. The checkout is provided by Stripe and shows the purchase as “Sold through Link”. Your contract for the course is with us. Stripe’s affiliate Sold through Link, LLC (“Link”) is the merchant of record for the payment: it charges your payment method, calculates and pays the sales tax, issues the receipt and invoice, and handles transaction support, refunds and payment disputes. For these steps Link’s terms for purchases “Sold through Link” also apply. Questions about the course itself are answered by us.
5. Prices and payment
Access to SQE1 costs £79 (GBP) as a one-off payment, including VAT and other sales taxes where applicable. Payment is made in advance in the checkout using the methods offered there; Link collects the payment (section 4). Depending on where you are, the checkout may offer to pay the price in your local currency, converted by Stripe. Your card or bank statement will show “LINK.COM*” followed by a short form of our name. If you pay in a currency other than that of your account, your bank may charge fees for currency conversion.
6. Term – no subscription
Access starts when your purchase is confirmed and ends automatically after 12 months. There is no subscription and no automatic renewal, so you do not need to cancel. You can buy another period at any time.
7. Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days – see our right of withdrawal page. Because access starts immediately after payment, you are asked to confirm the following next to the buy button before you can go to the checkout:
“I expressly request that you start providing the digital content (access to the course) immediately, before the 14-day cancellation period ends. I acknowledge that I lose my right to cancel once access has begun.”
With this consent and acknowledgement, and once we have confirmed them to you by email, your right of withdrawal ends when access begins. Without them, the 14-day right of withdrawal remains.
You can withdraw online with the function “Withdraw from contract here” (no sign-in needed), or by sending us a clear statement, for example by email. We confirm receipt of an online withdrawal by email straight away, with its content and the date and time we received it.
Refunds are paid out through Link to the payment method you used. Link’s terms for purchases “Sold through Link” also contain their own rules on refunds and cancellation, which remain unaffected. If the price is refunded in full, your access ends.
8. What you may do with the content
For the duration of your access, you receive a personal, non-exclusive and non-transferable right to use the course for your own exam preparation. You may not copy, publish, sell or share the questions or explanations, give others access to your account, extract content automatically (for example by scraping) or use it to train machine-learning models.
9. Content and updates
We update the content regularly, correct errors and adapt it when the law or the exam format changes; you receive these updates during your access period. Spotted a problem? Report it from any question. We use reports to correct the content. We may add, revise or withdraw individual questions, provided the course as a whole is not materially reduced. Each course states the date of the law it reflects. Your statutory rights in respect of defects in digital products (in Germany §§ 327 et seq. BGB) remain unaffected.
10. Availability
We aim to keep the app available at all times but may need to interrupt it briefly for maintenance, security or reasons beyond our control. We will keep interruptions as short as possible.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), limited to the damage that is typical and foreseeable for this type of contract. Otherwise our liability is excluded. These limits do not restrict your statutory rights as a consumer.
12. Blocking access
If you seriously breach these terms – for example by sharing your account or copying content – we may block your access after a warning, or without a warning where continued access cannot reasonably be expected. Your statutory rights remain unaffected.
13. Data protection
How we process personal data is explained in our privacy policy.
14. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory rules of the country where you have your habitual residence. If you are a merchant, the courts in Berlin have jurisdiction. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Final provisions
If any provision of these terms is invalid, the rest remains effective. The version of these terms that applied when you bought access governs that purchase.
